 Installation (Install)
Your Shopping Software will be installed on your server, under your domain name.
You need to make sure you have already in place the required tools

·   An active domain name

·   At least 10MB of web space

·   Access to an SQL database, and the tools to create and administer one

·   Server with the ability to run PHP scripts

Desirable

·   GD library

·   SSL certificate

·   cURL

Installation covers uploading of your Cart via FTP setting up the Database (if required) setting permissions for the scripts, installing our software, ensuring that the configure files are the correct permissions, deletion of the installation script.

If you already have SSL we can add this also.

** If extra work is required to install the package, due to server set ups which are beyond our control, HTACCESS rewrite not working this may be chargeable ***

Adding of product is not covered by the price, this is your responsibility.

Payment terms
Installation: Payment in full, in advance
Ready made store + Installation,
Payment in full in advance, or 50% before work and 50% upon completion.

Ongoing work, Development, Web Site creation both Showcase and E- Commerce
Ongoing work, creation of a web site etc... where an estimate has been given but not a fixed price payment will be made on a daily or weekly basis decided between you and us outstanding amounts will not be allowed to go over 7 days if this happen development will stop until payments are brought up to date.

We will agree with you a figure on which to pay before work commences
All passwords and user names we will hold until payment has been met in full.

Terms for Development of web sites Showcase, and E- Commerce.
Development of web sites will take place on a test server and remain on the test server until such time as it is ....
Finished and ready for public viewing and  paid in full.
If you want we are able to develop your site on your store, however payment has to take place in advance of work.

Informed
We will deliver to you each Day or week (depending on our agreement) a statement of account, listing a to pay amount that will need to be cleared in full via bank transfer of PayPal

Invoices
Invoices will be sent out once work has been finished; these must be paid in full within one week of sending.

Hand over
Passwords, user names and any other documentation will be handed over once the invoice is paid in full.

Hourly, half hourly rate
The rate includes,

•   Researching

•   Testing

•   Programming

•   Time spent backing up

•   As well as product implementation

For a commission and the first hour the hourly rate applies whether all of it is used or not. This the standard initial charge and no part of it is refundable
After the first hour billing is calculated in half hour cycles or part of.
If you need logs of any time spent on your project please specify prior to commencement of work.

Non payment
All invoices must be paid in full within one week of sending; late payments over this time may result in your site or our work being deleted. Automatic deletion will be carried out if non payment has occurred for more than three weeks.
If we take need to remove your site pending payment we will charge you for this to cover our time in making sure it will restore correctly, the cost of removing it and then returning it to the working state, to include all database functions, file permissions. Current Prices for removing a site are £100, and for Restoring the cost will be £100, paid in advance and funds cleared before a re-install is performed.
We have access to legal assistance in case of difficulty obtaining payments

Guarantee
All the work carried out is guaranteed against defects and / or defective programming; this is subject to checking for evidence of third party interference with the code / function. Before hand over it is expected that you have checked the work and are happy with it.
If another programmer is or has been commisioned to work on the site then the code base will no longer be supported as any arising defects found or experienced will not be proven to be from PowerosC system, therefore it is regrettable but necessary for us to remove the work guarentee.

Templates / Ready made stores
All templates are guaranteed to be free from defects, or known bugs in the code.
The OSC is supplied initially as a default store then enhanced with the Template, underlining OSC code is not guaranteed against, however best efforts will be made to try to correct any problems occurring.
Security issues with the site that may come to light or arise after purchase are your responsibility to act upon, and implement.
Others working on your site whilst under construction
If you, or anyone else  works on your site whist we are developing / working on it then rectifying any errors to make it work again will be an additional charge.
Unless we agree to this.

Updates
Unless otherwise stated, updates refer to the individual contributions installed in PowerOSC and not the holistic package when it is remade, this is due to the code being changed and may not be compatible with your version of Powerosc.
Periodically updates to the individual contributions included in PowerOSC are updated either by us or by third party, when an update is detected we will check the update to make sure it does enhance the functions of the contribution and if so we will then update our package and email clients with details of how to update their stores.
This can take the form of a file to replace or code to alter, best practice will be to send files though this is not always possible.
Minor updates to code are free, however Major version changes are not free and will need to be paid for.
Please make sure that our code will still be compatible with your store if you have made changes to it.

Servers.
We recommend you use Linux servers.
Powerosc (as is oscommerce) was created to run primarily on a Linux server, with htaccess support, any other type of server (Windows, Apple) some of the features of Power osc may not work. Therefore they will defunct and shall need to be suppressed.
Any type of contribution that needs to access the htaccess file will not work on a Windows server.
Some Linux servers are set up to not allow htaccess files, in this case we will set up your store as the server allows us to, and make it as close to original as is possible, further required work will result in additional charges.

Security
The security of your site is your own responsibility, where we install your site we will set up your store with the correct setting so far as is possible to run the site in a secure fashion.
The package will be up to date with current known security problems so if you are installing yourself please follow the install files to make sure that your file permissions are correct.

Release
We reserve the right to alter the contents of Powerosc from time to time with out communication.
Where this is a individual update you will be notified of this.

Full Service
This service uses already included technologies already found in PowerOSC
We will install and set up the following on your store.
Payment gateway, Shipping, Tax, store name, address, phone number, emails, countries, default currencies, language defaults, PDF image (if supplied) FCK Editor configure files, shipping, conditions, privacy wording that you supply, change the default logo to your supplied one, change test on the front page to supplied text, remove the existing products, attributes, and manufacturers, from the database, remove existing not required images from the images directory.

Ultimate service
We will register your required domain name (if available) in YOUR name with your details, we will arrange hosting for you again in your name,we will set up an email account you can use with Power osc for orders and contact,
We will install and set up the following on your store.

A synopsis of how this law affects you and your purchase on PowerosC
PowerosC is a downloaded software package, once you have downloaded you have lost your right to the 7 day cooling off period.
If you purchase and prior to downloading our software and within 7 days of purchase you decide you no longer require the software, you may write to us (E-mail is acceptable to us) stating that you no longer require the purchase to go ahead
We will then cancel the order and refund your purchase amount to you.
